Koda Systems provides software and automation tools for home improvement contractors and related businesses, including customer relationship management, lead follow-up automation, review management, and appointment scheduling.

You must be at least 18 years old and authorized to act on behalf of your business to use our services. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

By providing your mobile phone number to Koda Systems, you expressly consent to receive text messages from us. These may include:

• Responses to your inquiries
• Appointment confirmations and reminders
• Account and service notifications
• Customer support communications

Message frequency varies based on your interaction with our services.

Message and data rates may apply. Your mobile carrier's standard rates will apply to all messages sent and received.

To opt out, reply STOP to any message at any time. You will receive a confirmation message and no further messages will be sent.

For help, reply HELP or contact us using the information below.

Carriers are not liable for delayed or undelivered messages.

Consent to receive text messages is not a condition of purchasing any goods or services.

Subscription fees are billed monthly in advance. Fees are non-refundable except as required by law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with 30 days notice.

You agree not to use our services to:

• Send unsolicited messages or violate anti-spam laws including the TCPA and CAN-SPAM Act
• Send messages to individuals who have not provided proper consent
• Transmit unlawful, fraudulent, harassing, or misleading content
• Infringe on the intellectual property rights of others
• Attempt to gain unauthorized access to our systems

You are solely responsible for obtaining valid consent from any individual you contact through our platform and for compliance with all applicable communication laws.

You retain ownership of the data you upload to our platform. You grant us a limited license to use that data solely to provide the services. We will not sell or share your client data with third parties.

All content, branding, and materials on our website and platform are owned by BGF Dynamic Ventures LLC or its licensors and may not be reproduced without written permission.

Our platform integrates with third-party services. We are not responsible for the availability, performance, or policies of those services.

Our services are provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee any specific business results, lead volume, or revenue outcome from use of our services.

To the maximum extent permitted by law, BGF Dynamic Ventures LLC shall not be liable for any indirect, incidental, consequential, or punitive damages. Our total liability for any claim shall not exceed the amount you paid us in the three months preceding the claim.

We may suspend or terminate your access to our services at any time for violation of these Terms or non-payment.

These Terms are governed by the laws of the State of Idaho, without regard to conflict of law principles.

We may update these Terms at any time. Continued use of our services after changes constitutes acceptance of the revised Terms.
